Privacy of Your Personal Information

Each enterprise carrying on business at each Harvey Norman complex, under a name or style including the words “Harvey Norman” is operated by an independent franchisee (Franchisee) pursuant to a franchise granted by a subsidiary of Harvey Norman Holdings Ltd ACN 003 237 545 (HNH) (franchisor).  

This privacy policy applies to Druin Pty Ltd ACN 003 062 379 (as trustee of the Druin No. 3 Trust) trading as Harvey Norman Commercial Division Taren Point (referred to as “our”, “us”, “we”).

We respect your privacy and are committed to handling your personal information in accordance with the Privacy Act 1988 (Cth) (the “Act”) and this Privacy Policy explains how we manage your personal information we collect.


Collection of Personal Information
We may collect your personal information where it is necessary for us to carry out our functions and activities. You may provide us with personal information about yourself or others each time you deal with us in person, by telephone, letter, email or via www.harveynormansolar.com.au or www.harveynormancommercial.com.au (the “Website”). The information we collect may include your name, address, telephone number and email.

Use and Disclosure of Personal Information
You acknowledge and consent that by providing your personal information we may use and disclose your personal information for purposes related to the primary purpose for which the information was collected, or where you consent to such use or disclosure or where such use or disclosure is permitted by the Act. Generally, these purposes include fulfilling orders, improving our services, carrying out or responding to your requests, communicating with you, considering your applications for employment, or any other purposes outlined at the time you provide the information. We may not be able to do these things without your personal information. For example, we may not be able to contact you, deliver your order or offer employment to you.
In addition, we may to the extent permitted by law use and include your personal information in a database to market products and services offered by us or other franchisees to you personally, unless you have indicated that you do not wish to obtain such marketing offers or material. Such a request can be made to the Privacy Officer or by following the instructions in our marketing materials.
We may share your personal information with the franchisor, other franchisees, related bodies corporate, agents, contractors and suppliers to assist us in providing our products and services to you. These may include organisations that assist us with research, mail and delivery, security, professional advisory, banking, payment processing or technology services. We will not otherwise provide your personal information to a third party or transfer your personal information outside Australia or use, sell or disclose your personal information without your consent, unless we have your approval or are authorised by law.
You represent to us that where you provide personal information to us about another person, you are authorised to provide that information, and you will inform that person who we are, how we use and disclose their information, and that they can gain access to that information.
We sometimes handle personal information relying on exemptions under the Act, for example in relation to employee records, related bodies corporate, provision of services to State or Territory authorities, and operations outside Australia relating to personal information of non-Australians. Any permitted handling of personal information under such exemptions will take priority over this Privacy Policy to the extent of any inconsistency.


Securing Your Personal Information
We take reasonable steps to ensure that the personal information you provide is kept confidential and secure and not accessible for unauthorised use, amendment or disclosure. Personal information we hold on our systems is protected through the use of secure passwords and security procedures including physical, network and computer security. Access to your personal information is limited to those who need it to conduct their duties. We take reasonable steps to destroy or de-identify your personal information where it is no longer required.


Accuracy and Access to Personal Information
We take reasonable steps to ensure that the information we hold about you is accurate, complete and up-to-date.  To assist us to do this, please provide us with the correct information and inform us if your details change. You may request access to the personal information we hold about you at any time, provided your request is made in writing and you provide us with proof of your identity. Your request will be responded to in a reasonable time and you may be asked to pay any reasonable costs incurred by us in responding to your request. If we deny you access or deny a request for correction we will provide you with our reasons.


Additional Information for Users of the Website
If you visit the Website to read, browse or download information, the system may record information such as the date and time of your visit, the pages accessed and any information downloaded. This information is used for statistical, reporting and website administration and maintenance purposes. Like many websites, the Website may use "cookies" to collect this information. Cookies are small text files that are transferred to your computer’s hard drive through your web browser to enable the systems to recognise your browser. Any such information will be aggregated and not linked to particular individuals unless required by law. The default settings of browsers like Internet Explorer always allow cookies, but users can easily erase cookies from their hard-drive, block all cookies, or receive a warning before a cookie is stored. Some parts of the Website may not function properly if cookies are disallowed.
The Website may contain links to other sites. We are not responsible for the privacy practices or policies of those sites, including any third party site.
While care is taken to protect your personal information on the Website, unfortunately no data transmission over the Internet is guaranteed as 100% secure. Accordingly, we cannot ensure or warrant the security of any information you send to us or receive from us online. This is particularly true for information you send to us via email as we have no way of protecting that information until it reaches us. Once we receive your personal information, we are required to protect it in accordance with the Act.


Our Privacy Complaint Process
If you are concerned with the way your personal information has been handled, please contact or write to us, or alternatively, contact the franchisor’s Privacy Officer as set out below. If your personal information has not been handled in an appropriate way, we will take steps to remedy your concerns in a reasonable time.
